1. License Grant and Usage Restrictions

Omnibarber provides a non-exclusive, non-transferable, perpetual, lifetime software license for the operation of a single barbershop or salon brand/location. Upon purchase and deployment, you are granted the right to use the provided codebase and CMS to run your business operations. Under no circumstances are you permitted to resell, distribute, sub-license, copy, or deploy the Omnibarber platform or any portion of its source code to third parties or other businesses. The license is strictly tied to the single entity established during the initial order.

2. Acceptable Site and Software Usage

By using this presentation site and our software products, you agree to act in compliance with all applicable laws and regulations. You are strictly forbidden from attempting to disrupt, disable, compromise, or inject malicious code into the presentation site, the booking engine, or the administrative CMS. Any unauthorized access to the server, source code libraries, or user databases will result in immediate termination of your license and potential legal action.

3. Customization and CMS Limitations

The Omnibarber lifetime license includes access to a robust Content Management System (CMS). This CMS is explicitly designed to allow the client to update text content, localized translations, gallery imagery, and pricing structures. It does not grant the ability to modify the structural layout, HTML/CSS frameworks, or core logic of the chosen theme.

Any requests for structural theme changes, custom layout additions, new feature integrations, or bespoke design modifications fall outside the scope of the standard license. Such requirements will be treated as custom development and will incur additional, separately billed charges based on our hourly development rates.

4. Delivery, Hosting, and SLA

We configure and deploy the system on your target domain within 7 business days from the submission of all required assets. The package includes 1 year of complimentary hosting. While we make reasonable operational efforts to maintain server stability, we do not guarantee 100% server uptime and are not liable for any business disruptions, booking issues, or revenue loss resulting from hosting downtime. The client may migrate the assets to their own server infrastructure at any point.

5. Personal Data and GDPR Compliance

Once the Omnibarber booking system is deployed on your domain, You (the Barbershop Owner) assume full status and liability as the Data Controller for all personal data collected from your end-users (clients booking appointments). Omnibarber acts purely as the software supplier and has no access to, ownership of, or regulatory liability for the scheduling logs, phone numbers, or email addresses stored in your isolated database. You are solely responsible for ensuring your data processing operations comply with GDPR or local privacy regulations.

6. Payment Terms and Refund Policy

The lifetime license is acquired via a one-time payment as specified in your purchase agreement. Due to the nature of digital source-code delivery and deployment, all sales are final. Once the software has been deployed to your domain or the compiled code is made available for download, no refunds or chargebacks will be issued under any circumstances.

7. Limitation of Liability and Warranties

The software is provided "as is," without warranty of any kind, express or implied. Omnibarber does not warrant that the software will meet all your business requirements or run entirely error-free. In no event shall Omnibarber be liable for any direct, indirect, incidental, or consequential damages (including, but not limited to, loss of profits, loss of data, or business interruption) arising out of the use or inability to use the software, even if advised of the possibility of such damages.

8. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of laws principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts of London, UK.
